Terms and conditions for 4MAZAD application

A brief overview of the application:

[4MAZAD] It is an application owned by Kuwait Four Auctions Company in non-stores, and it is an application to organize public auctions electronically or private auctions according to the terms and conditions, the application allows the subscriber to sell or buy all types of goods, whether in kind or electronically, as determined by the terms and conditions.

Terms & Conditions:

No person, entity or company has the right to use the [4MAZAD] application or copy it for its benefit, knowing that this application holds intellectual property, and whoever violates this exposes himself to the provisions of the Penal Code, with the right of the owner company to recourse against him for compensation.
No person has the right to register with the application administration under the age of eighteen years, and if a person makes false statements that do not conform to the truth, he alone bears criminal and civil responsibility towards others and all their legal effects.
It is prohibited for any of the users to use the application to advertise anything that violates public morals or use the application for a purpose other than its intended purpose, and whoever violates these instructions exposes himself to legal accountability and the provisions of the Penal Code.
All things displayed are sold as they are received from the seller or supplier and the management of the [4MAZAD] application is not responsible for the declarations, specifications, information and details that the seller or supplier puts in his advertisement and the buyer is the first responsible for reviewing the data, advertisements and information related to the state of the displayed thing before he bids on it without any responsibility on the company and the management of the application. The sale and reversal of the purchase and the application is not responsible for the seller's rejection of the buyer's request or not.
All subscribers are obligated to update the application and ensure that the latest version of the application is used through the application store of your device before bidding.
The bidder has the right to refund the value of the paid subscription as a deposit to enter the auctions in the event that the bid is not awarded to him after three days from the date of requesting a refund of the security deposit.
The bidder is not entitled to recover the insurance amount in the event that the bid is awarded to him (auction) and the insurance amount becomes a pure right to Kuwait Four Auction Company in non-stores.

The company has the right to cancel any auction without incurring any responsibility towards the bidders.
The company has the right to delete, cancel or freeze any advantage without giving reasons and it is considered a sole right of the company.
The management of the [4MAZAD] application is not responsible for the displayed goods, their quality and durability, whatever they are, as the application is just an intermediary between the seller and the buyer and that the agreement was made between the seller and the buyer of their own free will without bearing any responsibility from the application management.
The application administration has the right to retain the personal data of subscribers and the operations they have carried out in the application.

Subscriber Rights:

The contributor has the right to recover the security deposit in the following cases:

In the event that the tender is not awarded, based on the general terms and conditions mentioned above

The subscriber has the right to recover the amount of the bid (commodity) paid in the following cases:

Failure to receive the item within five working days
In the event that the commodity is not transferred in the name of the buyer (according to the procedures and laws) within five working days
If the specifications mentioned in the bidding page of the application do not match

The contributor is not entitled to a refund of the security deposit in the following cases:

The amount of insurance in case the bid is awarded to him

The subscriber is not entitled to refund the amount of the auction (commodity) paid in the following cases:

In the event that the goods are received, inspected and conform to the aforementioned description
In the presence of any defect after receiving the goods
In the event that it is mentioned that these goods were in kind or electronically

Seller's Rights:

The seller is any person whohas expressed his desire to offer his products or anything he owns for bidding on the Four Mazad application.
The seller is responsible for what he has bid for, whether it is a commodity, merchandise or anything else without the slightest responsibility on the management of [4 MAZAD]
The approval of the application management for auction to display the product is an approval of the auction time and the required period only.
The application management has the right to reject the product offer.
The application management has the right to stop the auction or not to display it even after approval.
The seller is solely responsible for any legal liability to third parties.
The seller, when requested to display the product on the application for auction, means that he is the owner of the thing displayed or authorized to display it from the owner.
To manage the application, impose any fees or percentage for displaying or selling the product exclusively and not others.
Product display fee is non-refundable.
The percentage of sale after the completion of the transaction is non-refundable.
After the completion of the sale transaction and the approval of the seller, the money is transferred to the seller's account within three working days after receiving the amount from the buyer.
The buyer is responsible for payment in the event of his default, the seller is not entitled to demand the application management for any amounts.
The seller is not entitled to refuse to sell the product after the final approval of the offered price, and in the event of his rejection, the agreed sale percentage must be paid.
Any refund of goods sold by the Buyer to the Seller due to the Seller's fault (as stated in the Refund Terms) the Company has the right to demand that the Seller pay the percentage of the sale.
In the event of providing information contrary to reality, lack of clarity of description or cheating, the seller alone is responsible and does not have the right to demand the application management in any obligations.
The seller is not entitled to display anything contrary to laws and public morals .
Authorizing the seller Kuwait Four Auctions Company in non-stores, the owner of theFoo R Mazad application, to collect all fees and sale amounts through it and then transfer the amount minus the agreed percentage according to the contract.

Waiver of advertisements and published images:

The user is considered a waiver of the advertisement and the images attached to it immediately after uploading it to the application.
[4MAZAD] management reserves the right to reuse images posted in advertisements as it deems appropriate.

Intellectual Property Rights:

The [4MAZAD] application , owned by Kuwait Four Auction Company in non-stores, owns all intellectual property rights related to the application as well as all the contents of the application, including data, images and intellectual contents in all their forms on the application and on the website.
In no case may an attempt be made to quote the content of the application in whole or in an automated manner or a substantial part of it. It is also prohibited to use the content of this application within any other intellectual work or include it in an electronic database. The resale, distribution, modification, translation or re-engineering of the contents of this application in any way is strictly prohibited. The application management [4MAZAD] and Kuwait Four Auctions Company in non-stores reserve the right to place the necessary restrictions to prevent any person or other website from linking or quoting the content of this application.
It is also prohibited to re-engineer or disassemble the software used in the application with the aim of accessing the source software or the original code of that software or accessing the original structure of this application.

Itchor General:

The Auctioneer acknowledges that all data provided by him is correct and at his own risk and does not contain error or confusion.

The company is not responsible for any technical problem with the customer if he does not notify 24 hours before the end of the auction without the management of the [4MAZAD] application bearing any responsibility.
[4MAZAD] application management is not responsible for any malfunction that occurs due to internet speed during bidding.
The company is not responsible for any defect or problem that occurs with the auctioneer as a result of not updating the application and downloading the latest version from the Android and iOS stores ( iPhone and Android devices), as all customers are notified of updating the application periodically in the event that a new version is released.
In the event that the subscriber won more than one commodity, product, or car, and the seller or supplier agreed to sell it, and he paid the price of one commodity and left the other, then the value of the insurance or the down payment to enter the auction is a full right for the Kuwait Immediate Company to auction in other than stores.

Amendment to Terms and Conditions:

[4MAZAD] has the right to amend its terms and conditions of use at any time, and such modifications become effective as soon as they are posted on the application and users should review these terms and conditions of use periodically in order to review any amendments to them. The user's continued use of the application after making amendments to the terms and conditions is considered as an express approval of those amendments and an acknowledgment that he has reviewed and known them well without due diligence and acknowledged and agreed to them of his own free will.
